TERMS OF
SERVICE

This terms of use or service agreement ("Agreement") is between Icon Moment ("Company," "we," "us," or "our") and the person or entity ("you" or "your") that has decided to use our services; any of our websites; or any features, products, graphics, text, images, photos, audio, video, and all other forms of data and communications (collectively, "Services").

YOU MUST CONSENT TO THIS AGREEMENT TO USE OUR SERVICES. If you do not accept and agree to be bound by all of the terms of this Agreement, including the Privacy Policy, you cannot use our Services.

1. Description of the Services

Icon Moment provides a full range of premium event services in Dublin, including magazine-style photo booths with professional lighting and custom overlays, birthday and baby shower décor, custom backdrops, party and wedding styling, proposal décor, corporate event installations, and full event packages combining multiple services.

2. Accessing the Services

We reserve the right to change the Services and any material we provide in the Services at our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Services is unavailable at any time or for any period.

3. Intellectual Property

Our Property

Icon Moment owns all proprietary information, software code, and materials used to provide the Services. Our graphics, logos, and custom-designed magazine templates are protected by copyright and trademark laws.

User and Guest Content

• Ownership: Photos and videos captured by the booth during an event belong to the person who commissioned the event (the "Client"), subject to the license granted below.
• Grant of License: By using our Services, you grant Icon Moment a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, and publish photos and videos captured at your event for marketing, portfolio, and promotional purposes (e.g., website and social media), unless otherwise agreed upon in writing.

4. Your Use of the Services

Eligibility

By booking our Services, you represent that you: (i) are at least 18 years old; (ii) have the authority to enter into this Agreement; and (iii) will provide a safe environment/venue for our equipment and staff.

Prohibited Activities

You agree not to:

• Damage or misuse any company equipment, props, or installations.
• Use the Services for any unlawful activities.
• Reproduce or "scrape" any portion of our website content without written permission.
• Modify or attempt to reverse-engineer our digital sharing software.

5. Payments and Cancellations

Third-Party Payment Services

Where applicable, we may use third-party payment services to handle financial transactions. We are not responsible for disputes arising between you and any such payment processor.

Booking and Taxes

Pricing is determined by the package selected or an agreed-upon Order Form. Fees do not include applicable sales or use taxes unless specifically stated.

No Refunds

Consistent with our business model, we do not provide refunds for deposits or completed services. In the event of a cancellation by the client, the deposit may be forfeited according to the specific terms of your booking invoice.

6. Disclaimers and Limitation of Liability

Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. While we strive for the highest quality across all services, we do not guarantee that any element of service delivery will be uninterrupted or free from limitations outside our control (e.g., venue restrictions, access delays, or supplier availability).

Limitation of Liability

To the maximum extent permitted by law, in no event shall Icon Moment Photo Booth be liable for any incidental, special, or consequential damages. In no event shall our total liability exceed the total amount of money paid to us for the specific event in question.

Waiver of Liability

You waive any liability against us for injuries or damages sustained by you or your guests in association with any of our services, including injuries resulting from props, equipment, décor installations, or physical structures provided by Icon Moment, except in cases of proven gross negligence by our staff.

7. Dispute Resolution

For any claim between you and Icon Moment, you agree that the claim must be resolved exclusively in accordance with the laws of the jurisdiction in which the Company is registered. Before filing a claim, both parties agree to attempt to resolve the dispute through informal negotiation for a period of 30 days.

8. Entire Agreement

This Agreement, together with our Privacy Policy and your specific Event Booking Invoice, constitutes the entire agreement between us.
