This terms of use or service agreement ("Agreement") is between Icon Moment Photo Booth ("Company," "we," "us," or "our") and the person or entity ("you" or "your") that has decided to use our services; any of our websites; or any features, products, graphics, text, images, photos, audio, video, and all other forms of data and communications (collectively, "Services").
YOU MUST CONSENT TO THIS AGREEMENT TO USE OUR SERVICES. If you do not accept and agree to be bound by all of the terms of this Agreement, including the Privacy Policy, you cannot use our Services.
Icon Moment Photo Booth provides premium, studio-quality photo booth experiences for events. Our services include professional lighting, custom magazine-style overlays, instant digital sharing (via SMS, Email, or QR code), and physical printouts.
We reserve the right to change the Services and any material we provide in the Services at our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Services is unavailable at any time or for any period.
Icon Moment Photo Booth owns all proprietary information, software code, and materials used to provide the Services. Our graphics, logos, and custom-designed magazine templates are protected by copyright and trademark laws.
Ownership: Photos and videos captured by the booth during an event belong to the person who commissioned the event (the "Client"), subject to the license granted below.
Grant of License: By using our Services, you grant Icon Moment Photo Booth a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, and publish photos and videos captured at your event for marketing, portfolio, and promotional purposes (e.g., website and social media), unless otherwise agreed upon in writing.
By booking our Services, you represent that you: (i) are at least 18 years old; (ii) have the authority to enter into this Agreement; and (iii) will provide a safe environment/venue for our equipment and staff.

We use third-party payment services (such as Stripe) to handle financial transactions. We are not responsible for disputes arising between you and the payment processor.
Pricing is determined by the package selected or an agreed-upon Order Form. Fees do not include applicable sales or use taxes unless specifically stated.
Consistent with our business model, we do not provide refunds for deposits or completed services. In the event of a cancellation by the client, the deposit may be forfeited according to the specific terms of your booking invoice.
Our services are provided on an "as is" and "as available" basis. While we strive for "magazine-ready" quality, we do not guarantee that digital sharing will be uninterrupted (e.g., due to venue Wi-Fi limitations).
To the maximum extent permitted by law, in no event shall Icon Moment Photo Booth be liable for any incidental, special, or consequential damages. In no event shall our total liability exceed the total amount of money paid to us for the specific event in question.
You waive any liability against us for injuries or damages sustained by you or your guests in association with the use of the photo booth, including injuries resulting from props or equipment, except in cases of proven gross negligence by our staff.
For any claim between you and Icon Moment Photo Booth, you agree that the claim must be resolved exclusively in accordance with the laws of the jurisdiction in which the Company is registered. Before filing a claim, both parties agree to attempt to resolve the dispute through informal negotiation for a period of 30 days.
This Agreement, together with our Privacy Policy and your specific Event Booking Invoice, constitutes the entire agreement between us.
